There is lots of confusion about the proposal, what is
required, and when it becomes law. The USCIS has made it clear that
for fiscal year 2012, beginning October 1, 2011, the H-1b lottery,
as it has become known, will remain the same. Full package H1b
petitions will be accepted on April 1, 2011, without change.
Although theoretically I like the idea of a pre-registration, the
question remains for me: what is the process of registration, will
entities such as Microsoft, Apple, and others, who often file
hundreds, if not more, petitions, be able to capture and have set
aside multiple visas? That is, will they get to designate how many
H1b candidates they are registering for? If so, will they have to
identify the individuals? Will they be able to later substitute a
candidate? It is important to note that as of now this is only a
proposal, with little if any answers. It is a period of public
comment. My concern, and I am not alone, is how this process will
impact small employers and/or startups. Will they be at a
